What is Mediation

Mediation is an alternative way of resolving a dispute. The conflicting parties sit down together with a Mediator, who is a neutral third party. The Mediator tries to help the conflicting parties work out an agreement on their own. If an agreement is reached, it is a binding agreement. If a resolution is not reached, you still have the option of pursuing litigation.

What are the Benefits of Mediation?

There are several potential benefits of Mediation as compared to Litigation. Some of the potential benefits include:

  • Faster resolution to your problem
    • Litigation can take months or even years
    • Mediations typically last several hours and can often be scheduled within weeks
  • Generally less expensive than litigation
    • While it is not expensive to file a case, attorney’s fees, costs of obtaining evidence, expert witness fees, etc. can add up quickly
    • Depending on the situation and the Mediator, Mediations typically only cost each party up to a few hundred dollars or can even be free, and you are not required to have an attorney for a Mediation
  • More emotionally satisfying
    • In court, you are not really given the opportunity to “have your say”-you can testify but while giving testimony you are only allowed to answer specific questions and you are generally not allowed to make a statement
    • In a Mediation, you are given uninterrupted time to explain to the other party and to the Mediator what happened, how you feel about it, and how you might like to resolve it-you may even get an apology, which you’re unlikely to ever get in court
  • It’s not “Winner Take All”
    • In court, the party who succeeds will be granted a monetary award and the “losing” party will get nothing
    • In Mediation, you are free to find creative solutions that may or may not include a monetary award, and it is often possible for both parties to get what they want
  • You are not limited by the Law
    • In court, the Law is the only thing that matters, and the Law is not always fair
    • In Mediation, you are not bound by the Law-the parties are free to come up with any solution they see fit regardless of the legal merits of their case
